If your inspector hands you a Nonconformity notice this means for some reason your pool fence is not up to
Australian Standards and does not comply with the new laws.
The pool safety inspector must within 2 business days issue a Noncomformity notice to the pool owner
saying that the pool does not comply, why it does not comply and what must be done for it to comply .
The pool owner then has within 3 months to recall the same inspector to reinspect the pool to see if it complies.
It is an offence for the pool owner to ask another inspector within the reinspection period for the giving of a pool safety certificate unless the owner has been in contact and asked the local goverment and given the ok, or if the owner initially asked the pool inspector to inspect the pool.
If within the reinspection period the owner calls the inspector for a reinspection of the pool fence, the inspector must within 5 business days of the request or a longer period that the owner and the inspector decide to have the inspection done.
If at the end of the 3 months the owner fails to contact the pool inspector, the inspector 5 days after the 3 months must contact the local goverment of the failure and hand them a copy of the Nonconformity notice.
